These Terms of Service ("Terms") govern your access to and use of the services provided by BounceHalt ("we," "our," or "us"), including our website at bouncehalt.com and our email verification API (collectively, the "Service"). By using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

BounceHalt provides an email verification API that checks the deliverability of email addresses through multi-layered validation including syntax verification, DNS/MX record lookup, SMTP connection testing, and disposable/catch-all domain detection. The Service does not send emails to the addresses being verified.

3. Account Registration

To use the API, you must create an account and obtain API credentials. You are responsible for:

• Maintaining the confidentiality of your API keys and account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

4. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

• Use the Service to facilitate sending unsolicited bulk email (spam)
• Verify email addresses obtained without proper consent
• Attempt to reverse-engineer, decompile, or exploit the Service
• Use the Service to harvest or collect email addresses
• Exceed your plan's rate limits or attempt to circumvent usage restrictions
• Share your API keys with unauthorized third parties
• Use the Service in a manner that could damage, disable, or impair our infrastructure
• Use the Service to violate any applicable laws, including data protection regulations (GDPR, CAN-SPAM, CCPA)

5. API Usage and Rate Limits

Each pricing plan includes specific API call limits and rate limits. Usage beyond your plan limits may result in throttling, additional charges, or temporary suspension. We reserve the right to modify rate limits with reasonable notice.

6. Pricing and Payment

• Pricing is as listed on our website at the time of purchase
• Subscriptions are billed monthly or annually, depending on your chosen plan
• All fees are non-refundable unless otherwise stated
• We reserve the right to change pricing with 30 days' notice
• Failure to pay may result in account suspension or termination

7. Service Level

We strive to maintain 99.9% API uptime. However, the Service is provided "as is" and we do not guarantee uninterrupted or error-free operation. Scheduled maintenance windows will be communicated in advance when possible.

8. Accuracy Disclaimer

While we strive for the highest possible accuracy in email verification results, we cannot guarantee 100% accuracy. Email verification results are based on real-time conditions at the time of the request and may vary due to:

• Temporary mail server issues or greylisting
• Catch-all domain configurations
• Mail server policies that block verification attempts
• Network conditions and DNS propagation

Verification results should be used as one factor in your email deliverability strategy, not as the sole determinant.

9. Intellectual Property

The Service, including its code, design, documentation, and branding, is the intellectual property of BounceHalt and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

10. Data Processing

Verification data, including the email addresses submitted, is retained for bounded periods to support billing, audit, idempotency, and the features you use (see our Privacy Policy for retention details by data type). You may delete your account and associated data at any time. For enterprise customers requiring a Data Processing Agreement (DPA), please contact us.

11. Limitation of Liability

To the maximum extent permitted by law, BounceHalt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless BounceHalt from any claims, losses, or damages arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the Service ceases and any outstanding balances become due.

14. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of New Delhi, India.
